Terms of Service

Welcome to The Hippie Shake.

These Terms of Service ("Terms") govern your use of thehippieshake.co.uk and any purchase you make through it. Please read them before placing an order, as they set out your rights and obligations and ours.

Nothing in these Terms affects your statutory rights as a consumer.


1. About Us

Our store is hosted on Shopify Inc., which provides the ecommerce platform through which we sell to you.

2. These Terms

By accessing our website or placing an order, you agree to these Terms and to the policies referred to in them, including our Privacy Policy, Shipping Policy, Refund Policy and Cancellation Policy.

If you do not agree to these Terms, please do not use our website.

3. Using Our Website

You may use our website for lawful, personal, non-commercial purposes only. You must not:

  • Use the website or our products for any unlawful purpose, or in breach of any law applicable to you

  • Infringe our intellectual property rights or those of anyone else

  • Harass, abuse, threaten, defame, or discriminate against any person

  • Submit false or misleading information, or impersonate anyone else

  • Upload or transmit viruses or any other malicious code

  • Collect or track the personal information of others

  • Spam, phish, scrape, crawl, or use automated systems to extract data from the site

  • Interfere with or circumvent the security features of the website

We may suspend or withdraw your access to the website where you breach this section. Where we do so, we will give you notice unless the breach is serious enough to make immediate action necessary.

We do not guarantee that our website will always be available or uninterrupted, and we may suspend, withdraw, or change any part of it. Where we plan to do so, we will give reasonable notice where practical.

4. Placing an Order

By placing an order you confirm that:

  • The information you provide is accurate and complete

  • You have the legal capacity to enter into a binding contract, or have the consent of a parent or guardian if you are under 18

When you place an order, you will receive an email acknowledging that we have received it. This acknowledgement is not acceptance of your order. Your order is accepted, and a binding contract formed, when we dispatch the goods to you.

If we are unable to fulfil your order — for example because an item is out of stock — we will notify you as soon as possible and refund any amount you have paid in full.

We may refuse or cancel an order, or limit quantities per person, household, or order, where we reasonably believe an order has been placed by a dealer, reseller, or distributor, or where we suspect fraud or a breach of these Terms. Where we cancel an order you have paid for, we will refund you in full.

5. Prices and Payment

Prices are shown in your local currency and include applicable taxes and duties. The total amount payable, including delivery, is shown at checkout before you confirm your order.

International orders are shipped on a Delivered Duties Paid basis, so no additional duties or taxes are due on delivery. For US orders, state sales taxes are calculated separately at checkout where applicable.

We use Swap Commerce to provide our cross-border checkout, duties calculation, and international returns.

We accept credit and debit cards, PayPal, Clearpay, and Klarna. Availability of payment methods varies by location. Where you pay using a buy-now-pay-later provider, that provider's own terms apply to your payment plan in addition to these Terms.

Prices may change at any time, but changes will not affect an order we have already accepted.

6. Errors in Price or Description

We take care to ensure that prices, product descriptions, and images are accurate, but errors occasionally occur.

If we discover an error in the price or description of an item you have ordered, we will contact you before dispatch to ask whether you wish to proceed at the correct price or cancel the order for a full refund. If we cannot reach you, we will treat the order as cancelled and refund you in full.

Where a pricing error is obvious and unmistakable, and could reasonably have been recognised by you as an error, we may cancel the order and refund you even if we have already dispatched the goods.

7. Product Descriptions

We make every effort to display our products accurately. Slight variations in colour may occur due to your screen settings, and natural variation is inherent in some of the materials and finishes we use.

8. Delivery

Delivery options, costs, and estimated timings are set out in our Shipping Policy and shown at checkout.

We aim to dispatch orders within 1–2 working days (Monday–Friday). Delivery estimates are estimates and are not guaranteed unless you have selected a guaranteed service. Unless otherwise agreed, we will deliver within 30 days of your order.

Risk in the goods passes to you on delivery. This applies whether or not you have purchased optional shipping protection at checkout.

9. Cancellations, Returns and Refunds

Our Refund Policy and Cancellation Policy set out in full:

  • Your statutory right to cancel within 14 days of receiving the goods

  • Our 21-day returns window, which is in addition to that right

  • Return fees by region, and the options available to you

  • Which items cannot be returned

  • What happens if goods arrive faulty or damaged

Exchanges are available on UK orders only, subject to stock, and are not a statutory right.

10. Your Rights if Something Is Wrong

Under the Consumer Rights Act 2015, goods we supply must be of satisfactory quality, fit for purpose, and as described. Nothing in these Terms excludes or limits those rights.

11. Gift Cards and Store Credit

Gift cards are issued digitally and delivered by email. They can be redeemed against purchases on our website.

Gift cards do not expire. They cannot be exchanged for cash or refunded to a payment card, except where required by law.

Store credit issued in connection with a return is non-transferable and cannot be exchanged for cash. Full store credit terms are set out in our Refund Policy.

12. Promotions and Discount Codes

Unless stated otherwise:

  • Discount codes cannot be combined with any other offer or code

  • Codes apply to full-price items only and exclude gift cards

  • Codes have no cash value and cannot be applied retrospectively to an order already placed

  • Promotions run for the period stated and may be withdrawn or amended at any time before an order is placed

  • Where an order placed using a discount code is partially returned, we may recalculate the discount applied to the items you keep

Specific terms for individual promotions, competitions, or giveaways will be published with that promotion and take precedence over this section.

13. Your Account

If you create an account, you are responsible for keeping your login details secure and for keeping your account information accurate and up to date. Please contact us immediately if you believe your account has been accessed without your permission.

14. Intellectual Property

All content on our website, including text, product descriptions, photography, imagery, logos, designs, and the arrangement of the site itself, is owned by The Hippie Shake Ltd or its licensors and is protected by copyright and trade mark law.

You may view, download, and print content for your own personal, non-commercial use. Any other use — including reproduction, distribution, republication, resale, or use in advertising or AI training datasets — requires our prior written consent.

15. Content You Submit

If you send us reviews, photographs, competition entries, ideas, or other material, you grant us a non-exclusive, royalty-free licence to use, reproduce, edit, and publish it in connection with our business, including on our website, in email, and on social media, with credit where practical.

You confirm that any material you submit is yours to share, does not infringe anyone else's rights, and is not unlawful, abusive, or obscene. We are not obliged to publish, keep confidential, pay for, or respond to anything you submit, and we may remove content at our discretion.

16. Third-Party Links and Tools

Our website may link to or make available third-party websites and tools that we do not control. We provide access to them as they are, without warranty or endorsement, and we are not responsible for their content, accuracy, or practices. Please review their terms and policies before using them.

17. Privacy and Cookies

Your personal information is handled in accordance with our Privacy Policy and Cookie Policy.

18. Our Liability

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Breach of your legal rights in relation to the goods, including the right to receive goods that are as described, of satisfactory quality, and fit for purpose

  • Defective products under the Consumer Protection Act 1987

We are not liable for business losses. If you use our products for any commercial or resale purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.

19. Events Outside Our Control

We are not liable for any delay or failure to perform our obligations where this is caused by an event outside our reasonable control, including courier or postal delays, customs processing, industrial action, adverse weather, or failure of public networks. Where such an event occurs, we will contact you as soon as possible and, if the delay is substantial, you may cancel your order and receive a full refund.

If you have a complaint, please get in touch via our Contact Page. We will acknowledge your complaint within 48 hours and work with you to resolve it.

21. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in law or to our services. The version published on this page at the time you place an order is the version that applies to that order. Changes to these Terms will not apply retrospectively to orders we have already accepted.

22. General

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force.

If we do not insist that you perform any obligation under these Terms, or delay in enforcing our rights, that does not mean we have waived those rights.

These Terms, together with the policies referred to in them, form the entire agreement between us in relation to your use of our website and your purchase.

We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if this happens and will ensure it does not affect your rights.

This contract is between you and us. No other person has any rights to enforce any of its terms.

23. Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident outside England and Wales, you retain the benefit of any mandatory consumer protection rights available to you under the law of your country of residence, and you may bring proceedings in the courts of that country.
